On the date and time set for hearing, September 23, 1998 at 1:30 p.m., Complainant’s attorney Terry Bays Smith, Esq., appeared and stated on the record that Complainant wished to vacate the hearing and withdraw the complaint previously filed with the Registrar of Contractors. Respondent’s attorney Robert D. LaPointe, Esq. earlier informed the Office of Administrative Hearings that his client did not object to vacation of the hearing or withdrawal of the complaint. Good cause appearing, IT IS ORDERED vacating the hearing previously scheduled in this matter. IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors with the recommendation that the entire Citation and Complaint in Case Number 98-2152 be deemed withdrawn and closed.
