IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Hearing in this matter was duly scheduled to convene on July 23, 1999, before the undersigned administrative law judge of the Office of Administrative Hearings. Shortly prior to that date, NOTICE OF SETTLEMENT AND MOTION TO CONTINUE was filed by counsel for Respondent indicating the specifics of a settlement would be finalized in order to have the matter dismissed. On August 27, 1999, staff communications by this office with counsel for Complainant and Respondent confirmed that the specifics of the settlement agreement would promptly be submitted. By correspondence filed on September 29, 1999, Complainant expressed concern over the failure of counsel to finalize the settlement. By correspondence issued on October 1, 1999, the undersigned advised counsel and the parties that absent submission by October 8, 1999 of a stipulation by counsel to either dismiss or reset the compliance hearing, the matter would be returned to the Registrar of Contractors with the recommendation that the complaint herein be closed. No stipulation having been filed through this date; therefore: IT IS ORDERED that this matter be vacated from the calendar of the Office of Administrative Hearings, and remanded to the Registrar of Contractors with the recommendation that it be closed.
