IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The hearing in this matter was scheduled for May 5, 1998. Just before the hearing, this ALJ checked official ROC records on the Respondent’s license at issue and discovered that Respondent filed a Chapter 7 bankruptcy action on March 19, 1998, and that the ROC was notified of this on April 29, 1998. Complainant appeared at the hearing time and was told of the bankruptcy and automatic stay. She avowed that she would seek relief from the stay. The filing of a petition for bankruptcy automatically stays any other proceedings. Complainant is free to seek relief from the automatic stay with the Bankruptcy Court. However, until Respondent is discharged or the Bankruptcy Court grants relief from the stay, this matter cannot continue. IT IS ORDERED vacating the hearing in this matter and remanding it to the Registrar of Contractors. If Complainant does not get relief from the stay by August 1, 1998, it is recommended that the Registrar close this case. If Complainant does get relief from the stay, it is recommended that the Registrar request a new hearing date.
