Shortly prior to the date set for the continued hearing in the above- entitled matter, Appellant filed a written communication confirming that it no longer desired to pursue the pending administrative action and requesting that the scheduled continued hearing be canceled.

In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS HEREBY ORDERED that the hearing scheduled to convene on September 8, 1998 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that the entire appeal action be dismissed and terminated.
