IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On February 16, 1999, counsel for the Petitioner filed a withdrawal of request for hearing upon denial of certificate. On February 17, 1999, counsel for the Arizona Department of Insurance (“Department”) filed its response to that request wherein the Department represented that it does not oppose Petitioner’s withdrawal of request for hearing. This matter was noticed for a hearing to be held on February 25, 1999. Based on the above, the Administrative Law Judge recommends that the Director of the Department grant Petitioner’s request to withdraw its request for hearing upon denial of certificate. THEREFORE, IT IS ORDERED vacating this matter from the docket of the Office of Administrative Hearings and remanding it to the Director for any further appropriate action.
