During a recess of the hearing and prior to the presentation of any evidence into the record, the parties represented that they had reached a settlement of this matter that will be memorialized in writing as a Consent Order and presented to the Director of the Arizona Department of Insurance. Counsel for the Arizona Department of Insurance presented a Motion to Vacate the hearing based on the parties’ settlement of this matter and reserved the right to proceed to further hearing in the event that the Director of the Department does not execute the proposed Consent Order. Counsel for Respondent did not object to the Department’s motion. Based on the above, IT IS ORDERED vacating this matter from the docket of the Office of Administrative Hearings.
