HEARING: January 7, 1998 APPEARANCES: The Applicant/Appellant did not appear at the hearing; Assistant Attorney General Elizabeth Burns appeared on behalf of the Registrar of Contractors. ADMINISTRATIVE LAW JUDGE: Lewis D. Kowal _____________________________________________________________________
FINDINGS OF FACT
Applicant/Appellant (“Applicant”) did not present any evidence at the hearing as to why the Registrar of Contactors’ denial of Applicant’s license application should be reversed or why the license application should be approved.
CONCLUSIONS OF LAW
1. The Applicant, by its default in appearance at the hearing of this matter, failed to sustain the required burden of proving why the Registrar of Contractors’ denial of the Applicant’s license application should be reversed or why the license application be approved. 2. Counsel for the Registrar of Contractors made a Motion to Dismiss this matter based on the Applicant’s default.
RECOMMENDED ORDER
Based on the above, and in light of the lack of prosecution by the Applicant, the Administrative Law Judge recommends that the Motion to Dismiss be granted and that the Registrar of Contractors’ denial of Applicant’s license application be upheld. Done this day, January 8, 1998.
