This matter was scheduled for hearing on May 27th, 1998. On May 26th, 1998, the Respondent, through counsel, notified the OAH via facsimile transmittal that the parties have reached settlement of this matter and therefore that a hearing is no longer in order. The OAH offices ascertained that the Complainant is in agreement with the representation made by the Respondent’s attorney.

THEREFORE: Good cause appearing, the above entitled matter is vacated from the calendar of the Office of Administrative Hearings and it is recommended that Case No. 97F-2446-ROC, together with the claim upon which it is based, be dismissed.
