After a partial evidentiary hearing herein on September 18, 1997, the parties expressed an interest in settling the matter. The parties agreed to put their agreement in writing and submit it to be made part of the final order herein. On September 23, 1997, an order entered taking the matter under advisement.

On September 30, 1997, the written agreement was received by the OFFICE OF ADMINISTRATIVE HEARINGS. The agreement has been reviewed and appears to accurately reflect the recitations made at the time of the hearing, and further appears to be a fair and just resolution of the matter.

The written agreement, which is attached hereto, is hereby incorporated herein by reference and made a part of this recommended order.

RECOMMENDED ORDER

It is recommended that the Director of the Arizona Registrar of Contractors dismiss Citation and Complaint No. 97-1834.
