IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This case is currently set for hearing on September 16 and 17, 1997. On July 24, 1997, the undersigned ALJ granted Respondent’s Motion for More Definite and Detailed Statement, ordering Complainant to file a statement of issues on or before August 15, 1997. Complainant did not file a statement of issues. This Office did receive a fax message from Complainant on August 15, stating simply “You can drop the case--I will send a letter within 2 days.” No letter ever came to this Office. On August 20, 1997, Respondent filed a Motion to Dismiss, for the reason that Complainant had not complied with this ALJ’s order. Complainant has not responded to the dismissal request. Good cause appearing, Respondent’s motion is granted. IT IS ORDERED that the hearing set for September 16 and 17, 1997, is vacated. IT IS RECOMMENDED that the Registrar dismiss the Citation and Complaint in Case No. 97-1125, Docket No. 97F-1125-ROC. Done this 28th day of August 1997.
