IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The Arizona State Board of Nursing issued a Complaint and Notice of Hearing in this matter on April 4, 2000, with service to Respondent by certified mail on that same date. The Complaint notified Respondent that, if she did not file a written answer to the Board within “30 days after service of this Complaint,” default would be entered against her. On May 8, 2000, the Office of Administrative Hearings received a letter from Respondent generally disputing the facts alleged in the Complaint and Notice of Hearing. Copies of Respondent’s letter were sent to the Board and its attorney. On May 12, 2000, the Board issued its Notice of Withdrawal of Hearing. Because it appears that Respondent’s answer was untimely under A.R.S. § 32-1164.H, the Board’s decision to enter default against Respondent appears to be supported by the record. Therefore, Pursuant to the action of the State Board of Nursing, a copy of which was provided to Respondent, and pursuant to OAH Rule R2-19-111, the above- entitled matter is hereby vacated from the calendar of the Office of Administrative Hearings.
