IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On January 20, 1998, Applicant Simone G. Tresner filed a document with the Office of Administrative Hearings requesting that her appeal of the the denial of her insurance license application by the Arizona Department of Insurance (the “Department”) should be cancelled. Counsel for the Department filed a Response on January 21, 1998, wherein the Department considered the Applicant’s request as a motion to vacate the hearing . The Department does not object to the hearing being vacated. This Administrative Law Judge views the Applicant’s as a withdrawal of her appeal of the denial of her insurance application and a request to vacate the hearing on the denial of the application. Based on the above, IT IS ORDERED that the hearing of this matter set for February 5, 1998, be vacated from the calendar of the Office of Administrative Hearings.
