ORDER REGARDING SUBPOENA REQUEST
Based on Respondent’s previous request and stated availability, this matter was continued for administrative hearing to be conducted on May 18, 2026. On May 6, 2026, Respondent requested a further continuance due to more recently determined unavailability; that date has not yet been calendared.
On May 6, 2026, Respondent also requested subpoenas for depositions of multiple individuals as well as other documents from an entity, indicating he had not yet received disclosure of such background documents from the Board of Technical Registration.
Arizona Revised Statutes (Ariz. Rev. Stat.) Section 41-1092.07(F)(4) provides as follows, in pertinent part:
On application of a party or the agency and for use as evidence, the administrative law judge may allow a deposition to be taken, in the manner and on the terms designated by the administrative law judge, of a witness who cannot be subpoenaed or who is unable to attend the hearing. ... Notwithstanding section 12-2212, subpoenas, depositions or other discovery shall not be allowed except as provided by this paragraph or subsection C of this section.
Ariz. Rev. Stat. Section 41-1092.07(C) provides as follows, in pertinent part:
The administrative law judge may issue subpoenas to compel the attendance of witnesses and the production of documents. ...
Based on the foregoing,
IT IS ORDERED Respondent’s request for subpoenas for the listed individuals for depositions is denied.
IT IS FURTHER ORDERED all requests for subpoenas for witness attendance at hearings or production of documents shall be prepared and submitted on the Tribunal’s form as found on the Tribunal’s website.
