In the Matter of: No. 26F-H116-REL
Evelyn Keiling, TTE - The Keiling Living MINUTE ENTRY: Trust , ADVISEMENT TO PARTIES
Petitioner, v. Lone Mountain Community Association, Respondent.
The Administrative Law Judge, having reviewed the document filed by Petitioner dated August 12, 2026, makes the following minute entry: The REQUEST FOR ADRE RESPONSE, HEARING DISCLOSURES AND SPECIFIC MEETING MINUTES RECORDS REQUEST appears to request documents. If either party cannot retrieve relevant documents voluntarily, the process for subpoenas may be found on the Office of Administrative Hearings (“OAH”) website at azoah.com/subpoena.html. The OAH does not prepare and/or serve subpoenas. See Ariz. Admin. Code R2-19-111. Second, best practice is to have disclosures (witness list and proposed exhibits) submitted five business days prior to the hearing which, in this matter, would be August 21, 2026, uploaded to the OAH portal and provided to the other party. Refer to the Notice of Hearing dated June 25, 2026, for additional detailed information. Lastly, this matter is a one-issue matter paid with a $500.00 filing fee with the issue listed in the Petition and in the Notice of Hearing as such, “Petitioner alleges the Respondent of violating Article 3, Section 3.1 and Design Guideline Sections 1.5 & 5.1.7 by “imposing a new mandatory wall color requirement not contained in the CC&R’s and applying to existing, compliant properties.” No other issue will be addressed at the upcoming scheduled hearing on August 28, 2026 at 9:00am.
