MOTION TO DISMISS

Pending before the Office of Administrative Hearings is Respondent’s Motion to Dismiss and Petitioner’s Response in opposition thereto.

Upon review and consideration of the filings, and given that there appear to be disputed issues of fact, a hearing on the merits is warranted.

As to Respondent’s contention that the Arizona Department of Real Estate does not address HOA or CC&R violations, it administers the dispute process and the Office of Administrative Hearings is vested with the jurisdiction to adjudicate such disputes.

Therefore,

IT IS ORDERED DENYING Respondent’s Motion to Dismiss.
