PREHEARING ORDER

A Prehearing Conference was held on April 16, 2026, at 10:00 a.m. Rachael Carrico, Esq. represented Applicant. Bradford Borman, Esq. represented the City of Tucson. Dr. Deron Davenport appeared on his own behalf.

To summarize what was discussed at the pre-hearing conference:

The parties agreed that the hearing will more than likely conclude in the three hours allotted on April 27, 2026, at 9:00 a.m., notwithstanding the possibility of up to a total of eight witnesses being called to testify;

The parties agreed that the order of presentation would be: Applicant, City of Tucson, Dr. Davenport;

The parties agreed to present oral closing arguments in lieu written closing arguments;

On or before April 20, 2026, at 5:00 p.m., the parties shall file with the Office of Administrative Hearings and provide a copy to all parties, the exhibits that they plan to submit, along with a List of Exhibits that provides a designation and brief description of each exhibit, as well as a List of Witnesses whose testimony they plan to present, along with a brief description of the witnesses’ anticipated testimony;

The City of Tucson and Dr. Davenport, along with their witnesses, agreed to appear virtually for the hearing. Ms. Carrico was provided until Monday, April 20, 2026, to decide whether she wished to appear in-person or virtually. On April 16, 2026, Ms. Carrico advised the Office of Administrative Hearings that she would also appear virtually with her witnesses;

The hearing will convene on April 27, 2026, at 9:00 a.m., and will be conducted either by video conferencing or telephone participation through Google Meet as follows:
