FINDINGS OF FACT
The Arizona Department of Public Safety (“Department”) referred the above-aforementioned matter to the Office of Administrative Hearings (“OAH”), an independent state agency, for an evidentiary hearing.
The Department issued a Notice of Hearing, setting a hearing at 10:00am on October 7, 2025. The Department mailed a copy of the Notice of Hearing to Appellant at her address via certified mail.
On September 8, 2025, an Order from OAH advised the parties on how to connect to the hearing via Google Meet.
Appellant failed to appear at the hearing by 10:15am on October 7, 2025 and consequently, the matter was not convened and no evidence was taken. OAH did not receive any further communication from Appellant in regards to the missed hearing on October 7, 2025.
CONCLUSIONS OF LAW
The Notice of Hearing that the Department mailed to Appellant at its address of record was reasonable and Appellant was deemed to have received notice of the hearing. See Ariz. Rev. Stat. § 41-1092.04; Ariz. Rev. Stat. § 41-1061(A).
By failing to appear at the hearing, Appellant did not meet the burden to present evidence in support of the complaint. See Ariz. Admin. Code R2-19-119.
RECOMMENDED ORDER
Based on the foregoing,
IT IS RECOMMENDED that Appellant’s appeal is dismissed.
IT IS FURTHER RECOMMENDED that the hearing is vacated from the calendar of OAH and remanded to the Department for any further action.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
