FINDINGS OF FACT
1. A hearing in the above-entitled matter was set to convene at 1:00 p.m. on June 4, 2026.
2. Ali Noor-Dean (Mr. Noor-Dean) failed to appear at the hearing set on
Mr. Noor-Dean’s behalf. Consequently, the hearing was not convened, and no evidence was taken.
3. Mr. Noor-Dean did not contact OAH prior to the hearing date to provide a telephone number where Mr. Noor-Dean would be called to participate in the hearing or indicate that Mr. Noor-Dean would appear in-person or by video conference.
4. No communication was received by OAH on behalf of Mr. Noor-Dean to provide notice of unavailability, to appear via alternative means, or to continue the hearing to a later date.
5. Although afforded a fifteen (15) minute grace period, no representative for Mr. Noor-Dean appeared at the hearing. Consequently, the hearing was not convened, and no evidence was taken.
6. There is no evidence that Mr. Noor-Dean subsequently contacted OAH to provide an explanation for not appearing at the scheduled hearing.
CONCLUSIONS OF LAW
1. The burden of proof in this matter is on Mr. Noor-Dean. See Arizona Administrative Code R2-19-119.
2. By failing to appear and prosecute the appeal, the appeal is unsupported by evidence and Mr. Noor-Dean has failed to meet the required burden of proof. Consequently, Mr. Noor-Dean’s appeal should be dismissed.
RECOMMENDED DECISION
In view of the foregoing, it is recommended that Mr. Noor-Dean’s appeal be dismissed.
Pursuant to A.R.S. § 41-1092.08(I), the licensee may accept the Administrative Law Judge Decision by advising the Office of Administrative Hearings in writing not more than ten (10) days after receiving the decision. If the licensee accepts the Administrative Law Judge Decision, the decision shall be certified as the final decision by the Office of Administrative Hearings.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
