PREHEARING ORDER
A prehearing conference was held on June 19, 2025, at 9:00 a.m. Assistant Attorney General Victoria Bergin represented the Arizona State Board for Charter Schools. Deanna Rader, Esq. and Gregory Bordo, Esq. represented American Virtual Academy.
To summarize what was discussed at the pre-hearing conference:
The hearing will convene as previously scheduled on September 8, 2025, at 9:00 a.m., and on subsequent consecutive dates thereafter through September 11, 2025, as necessary.
The hearing will be conducted in person at the Office of Administrative Hearings (“OAH”) located at 1740 West Adams Street, Lower Level, Phoenix, Arizona 85007.
On or before August 25, 2025, at 5:00 p.m., the parties shall file with OAH and provide a copy to the opposing party, the exhibits that they plan to submit, along with a List of Exhibits that provides a designation and brief description of each exhibit, as well as a List of Witnesses whose testimony they plan to present, along with a brief description of the witnesses’ anticipated testimony.
The parties further agreed that they would file prehearing statements one week prior to the hearing date.
Mr. Bordo requested leave for depositions of certain individuals. Ms. Bergin indicated that those individuals will be available to testify at hearing. Therefore, depositions were determined not to be necessary.
The parties indicated that an informal settlement conference has not yet been requested and that the parties will consider participating in such.
Prior to the hearing, the parties are urged to discuss stipulations to the admission of exhibits, as well as to facts that are not in dispute. Such will result in a more efficient hearing process.
