ORDER DENYING MOTION TO QUASH

Pending before the Office of Administrative Hearings is the Arizona State Board for Charter Schools’ (“Board”) Motion to Quash Subpoena Duces Tecum and American Virtual Academy dba Primavera Online School’s (“Primavera”) Response thereto.

Upon review and consideration,

IT IS ORDERED DENYING the Motion to Quash as no good cause has been demonstrated. Further, in light of the fact that although the Board asserts “all relevant communications and records, if any, that refer or relate to Neal David Sutz and American Virtual Academy/Primavera Online would be obtained by the July 1, 2025 subpoena and/or the June 11, 2025 public records request,” Primavera indicated that the “Board has failed to produce any documents responsive to this request,” and the Board did not indicate in its Motion that it has complied with either.
