ORDER SETTING CONTINUED
HEARING DATES
AND PREHEARING ORDER
A virtual prehearing conference was held on November 5, 2025. Greg Bordo, Esq. and Deanna Rader, Esq. represented American Virtual Academy. Assistant Attorneys General Victoria Bergin and Joe Cada represented the Arizona State Board for Charter Schools (“Board”).
To summarize what was discussed at the pre-hearing conference:
IT IS ORDERED that the continued hearing will convene on April 14, 2026, at 9:00 a.m., and on subsequent consecutive dates thereafter through April 17, 2025, as necessary, and as requested by the parties. Also as requested by the parties, the hearing will be conducted in person at the Office of Administrative Hearings located at 1740 West Adams Street, Lower Level, Phoenix, Arizona 85007.
On or before March 3, 2026, at 5:00 p.m., the parties shall submit any requests for subpoenas to the Office of Administrative Hearings (“OAH”).
On or before March 10, 2026, at 5:00 p.m., the parties shall file with OAH and provide a copy to each other, the exhibits that they plan to submit, along with a List of Exhibits that provides a designation and brief description of each exhibit, as well as a List of Witnesses whose testimony they plan to present, along with a brief description of the witnesses’ anticipated testimony. The parties shall also file stipulations as to the admission of exhibits by this date. The Board shall mark its exhibits numerically and American Virtual Academy shall mark its exhibits alphabetically. In the event the parties submit combined exhibits, they shall be marked numerically.
On or before March 17, 2026, at 5:00 p.m., the parties shall file with OAH a joint statement of facts and issues, as well as any stipulations to facts.
On or before March 24, 2026, at 5:00 p.m., the parties shall file any Motions in Limine.
On or before March 31, 2026, at 5:00 p.m., the parties shall file responses to any Motions in Limine.
On or before April 7, 2026, at 5:00 p.m., the parties shall file their prehearing statements.
The parties agreed to oral closing arguments.
The parties further agreed that if they choose to utilize a court reporter for the hearing, the court reporter’s transcript will be the official record of the proceeding and OAH will be provided a copy of the transcript.
