STATUS DATE

On March 3, 2026, the parties filed a Stipulation to Vacate March 12, 2026 Hearing and to Submit Issues Via Briefing.

On March 4, 2026, the Tribunal issued an Order granting the parties’ Stipulation, vacating the March 12, 2026 hearing date, and ordering that the parties adhere to the following briefing schedule:

(1) Complainant Marc Prochello shall file his brief on April 24, 2026;

(2) Respondent Canyon Trails Unit 4 West Community Association shall file its Response on May 22, 2026;

and

(3) Complainant Marc Prochello shall file his Reply on June 5, 2026.

The Order further advised that upon completion of the briefings, the parties would be informed as to whether the Administrative Law Judge deemed it appropriate to set a hearing on the matter or whether a Decision would issue based upon the parties’ briefs.

On June 10, 2026, Office of Administrative Hearings staff emailed the parties the following:

Please provide a status as to this matter. Neither party has complied with the filing deadlines set forth in the March 4, 2026 ORDER GRANTING STIPULATION TO VACATE MARCH 12, 2026 HEARING AND TO SUBMIT ISSUES VIA BRIEFING.

To date, neither party has submitted any filings to the Office of Administrative Hearings.

Therefore,

The above-entitled matter is continued and set for a FINAL STATUS UPDATE to be received no later than 12:00 p.m. on June 18, 2026.

If the parties do not submit a status update by 12:00 p.m. on June 18, 2026, the Administrative Law Judge will conclude that the matter has been resolved or Petitioner does not wish to proceed with a hearing and the matter will be vacated.
