Subject: Unfulfilled Records Request – Statutory Violation Notice

Dear Board Members and Management Representatives,

We are now past the 10-day statutory period for responding to my official records request submitted under A.R.S. §33- 1805.

This request was first sent on June 25, 2025 at 6:54 AM, with a follow-up containing additional details on June 26 at 2:09 PM. Both requests are embedded within the same email chain. As of today, no response has been provided.

I fully understand this may be an administrative inconvenience. However, Cadden Community Management never notified the Board of the petition’s receipt, and I personally have not been given the courtesy of any proof of delivery date, which should be simple to provide. As a result, I have been forced to independently research metadata to determine internal document handling.

Due to the failure to provide the requested documentation, this records request violation is now being included as part of my formal complaint to the Arizona Department of Real Estate (ADRE).

And, your email to a homeowner stating that you had provided notice of the petition to the board members which I know to be false, creates disbelief in other statements.

This was an official records request. And, now this is added to the request as an official records request:

I am also requesting copies of all emails to and from Cadden personnel and any and all Agua Dulce members regarding the recall - both prior to Cadden receipt of the petition and after Cadden receipt of the petition.

Please provide me a copy of documentation showing time and date of the receipt by Cadden - Petition with signatures to recall Barb Kunkel. The petition was received by Cadden on or around May 29, 2025. This records request will be attached to the documentation sent to the ADRE. If/when there is a response, that will be attached as well.

Please notify receipt of this request and the records request sent June 25, 2025.
