Pending before the Office of Administrative Hearings is Wynstone Park Homeowners Association’s Motion to Dismiss the Petition. Sally Magana has filed a response.

On July 17, 2025, Sally Magana filed a two-issue petition alleging the following:

(1) The Association violated “Title 8, Chapter 6, Article I, 8-6-3: PUBLIC NUISANCES PROHIBITED” by assessing a fine for public nuisances for parking on approved driveway extension.

(2) The Association violated CC&R Section 7.1, Architectural Approval by mischaracterizing maintenance as an unauthorized modification.

The tribunal has not received a copy of “Title 8, Chapter 6, Article I, 8-6-3: PUBLIC NUISANCES PROHIBITED” and CC&R Section 7.1, Architectural Approval. Ms Magana must provide a copy of ““Title 8, Chapter 6, Article I, 8-6-3: PUBLIC NUISANCES PROHIBITED” and CC&R Section 7.1, Architectural Approval, no later than September 19, 2025.
