In the Matter of No. 25F-H056-REL R.L. Whitmer, CORRECTED ORDER GRANTING STAY PETITIONER, v.

Hilton Casitas Council of Homeowners, RESPONDENT.

At the request of Petitioner and good cause appearing, the hearing in the above- entitled matter is continued and set for a STATUS UPDATE on Wednesday, September 17, 2025.1 On or before this date Petitioner shall submit one of the following motions to the Office of Administrative Hearings (“OAH”): (1) Inform the tribunal that the matter has been satisfactorily resolved by submitting a MOTION TO VACATE the hearing; (2) Inform the tribunal that the parties need additional time to resolve the matter by submitting a MOTION TO CONTINUE and reset for STATUS by 30-days, 45-days, or 60-days, or (3) Inform the tribunal that the parties are unable to resolve their dispute and request that the matter be SET FOR HEARING.2 Failure to timely submit a STATUS UPDATE may result in the matter being vacated from OAH’s calendar and remanded to the referring agency for further action, if any, pursuant to ARIZ. ADMIN. CODE R2-19-111(4). Done this day, August 04, 2025.

Petitioner shall have until Tuesday, September 02, 2025, to file an action related to the above-captioned matter with the Arizona Department of Real Estate (“Department”). If the Department accepts the petition, including payment for the corresponding number of additional issues, and agrees to consolidate that action with the pending matter, an AMENDED NOTICE OF HEARING will be issued by the Department setting the consolidated matters for hearing in Fall 2025. Notably, this Order does not prevent or discourage the parties from attempting to settle their underlying dispute(s) in the interim. Please include any date(s) and/or time(s) of unavailability 30-60 calendar days from the date of your request to prevent further delay of these proceedings.
