ORDER DENYING RESPONDENT’S MOTION TO DISMISS

The Administrative Law Judge (“ALJ”), having reviewed the document filed on March 26, 2025 by Sunland Village East Association (“Respondent”) makes the following minute entry:

Respondent’s Motion to Dismiss was considered and is denied. The ALJ will hear the allegations as alleged by Petitioner per the Homeowners Association Dispute Process Petition filed on February 19, 2025 at the Tribunal hearing scheduled on May 5, 2025 at 1:00pm. Complainant has the burden to prove these allegations by a preponderance of the evidence per Ariz. Admin. Code R2-19-119.

The ALJ’s decision will be binding per Ariz. Rev. Stat. § 32-2199.02(B).
