In the Matter of No. 25F-H036-REL John R Krahn Living Trust/Janet Krahn Living Trust, ORDER NUNC PRO TUNC Petitioner, CORRECTING HEADING v. Tonto Forest Estates Homeowners Association, Respondent.

In the June 8, 2025 Administrative Law Decision (Decision) in the above captioned matter, the Administrative Law Judge incorrectly listed, within the Heading portion of the Decision, the Petitioner’s Exhibits that were admitted to the hearing record. The Decision Heading portion stated:

EXHIBITS ADMITTED INTO EVIDENCE: Arizona Department of Real Estate Notice of Hearing Packet/File (File); Petitioner’s Exhibits 1 through 22;1 Respondent’s Exhibit (1). The Decision Footnote #1 therein stated: On May 13, 2025 at 5:53 p.m., Petitioner filed Amended Exhibits 1 through 26; Petitioner had added Exhibits 23 through 26 to his original exhibit filing. The Amended Exhibits were e-filed with OAH and e-copied to the community manager, but not to the Board President. At the time of the administrative hearing, the Board President did not have a copy of the Amended Exhibit package.

This ORDER NUNC PRO TUNC is issued to correct the Heading portion of the Decision to state as follows: EXHIBITS ADMITTED INTO EVIDENCE: Arizona Department of Real Estate Notice of Hearing Packet/File (File); Petitioner’s Exhibits 1 through 26; Respondent’s Exhibit (1).
