The undersigned Administrative Law Judge, having reviewed the documents Response to Petition filed by Respondent January 19, 2025, and Reply to Respondent’s Response filed by Petitioner February 26, 2025, makes the following minute entry:

The parties are advised that the only issue for hearing is an alleged event, conduct, or occurrence within Respondent’s immediate control amounting to a violation of Arizona Revised Statutes (“Ariz. Rev. Stat.”) §§ 33-1802(A)(1), 33-1803(B-E), 33-1804, and 33-1817, and Covenants, Conditions & Restrictions (“CC&Rs”) Article V.

Ariz. Rev. Stat. Title 10 is inapplicable to these proceedings as these statutes fall outside the jurisdiction of the Arizona Department of Real Estate. As such, no evidence or argument relating to these statutes shall be accepted by this Tribunal from either party.
