On December 23, 2024, the Arizona State Retirement System issued a Notice of Hearing in the above-captioned matter which set an administrative hearing at 9:00 a.m. on January 28, 2025, before the Office of Administrative Hearings (“OAH”), an independent state agency, to determine whether grounds exist to justify its appealable agency action; specifically, the denial of Appellant’s request to “opt-out” of mandated contributions pursuant to Ariz. Rev. Stat. §§ 38-711, 38-712, 38-727, 38-736, 38-761, and Article 29 of the Arizona Constitution.

On January 28, 2025, both parties appeared at the time scheduled for hearing and presented their evidence before the Tribunal. Each party was permitted to provide opening statements, present testimony, offer evidence for admission into the record, cross examine adverse witness(es), and provide closing arguments. Ultimately, after both parties rested, the record was closed for the acceptance of further testimony or evidence, save the receipt of hearing transcripts by certified court reporter Teresa Watson (CCR No. 50876) no later than February 14, 2025.

On January 29, 2025, OAH received 4-page document from Appellant titled Final Statement.

As a result of the foregoing, the undersigned issues the following:

IT IS ORDERED that Appellant’s Final Statement is rejected. The document will not be considered as it was inappropriately submitted. No further action can be taken in this matter by either party. Although the document will be retained in the docket, it should not be responded to by anyone.
