ORDER VACATING HEARING

On December 1, 2025, Respondent Arizona Department of Environmental Quality (“Department”) submitted a Respondent ADEQ’S Motion to Vacate Hearing because the matter has been dismissed.

Based on the Department’s dismissal, this matter is moot and a hearing is no longer necessary, pursuant to Ariz. Admin. Code R2-19-111.

IT IS ORDERED that the hearing in this matter scheduled on December 29, 2025, is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Department for further action.
