HEARING
A hearing in the above-entitled matter was set to convene on July 10, 2025 at 9:00 a.m.
At the hearing on July 10, 2025, Kimberly K. Clark AKA: Kimberly Katherine Clerk (hereinafter “Respondent”) admitted, under oath before the Court, that she did not object to the Board’s summary suspension of her nursing license, she welcomed the summary suspension, and she was not returning to practice as a nurse due to her health limitations. The parties requested that the matter be set for a status update to afford the parties additional time to finalize a settlement agreement.
The matter was set for a status update by October 8, 2025.
On October 7, 2025, Respondent’s counsel notified the tribunal that due to Respondent’s health and competency, she could no longer participate in any proceedings or enter into any additional stipulations.
On October 17, 2025, the Board’s counsel requested that the tribunal affirm the summary suspension and remand the matter to the Board for any remaining issues. Respondent’s counsel did not object. Therefore,
IT IS ORDERED that the May 22, 2025 Order summarily suspending Respondent’s license is affirmed.
IT IS FURTHER ORDERED that the above-entitled matter is remanded to the Board for further action pursuant to Arizona Administrative Code R2-19-111 (4).
