On June 12, 2025, the Arizona Department of Public Safety (“Department”) through its Counsel filed a Motion to Vacate.

On June 16, 2025, Complainant Rachael Martinez filed an Objection to Motion to Vacate and Motion to Appear Telephonically.

Having reviewed the filings and considering all of the arguments pursuant therein this Administrative Law Judge concludes that because the parties do not agree to vacate the hearing, the hearing will move forward as scheduled. See Ariz. Admin. Code R2-19-111(1).

It is Ordered denying the Department’s motion.
