ADVISEMENT TO PARTIES

ORDER REGARDING DISCLOSURES

The Administrative Law Judge (“ALJ”) having reviewed the subpoena request sent to the Office of Administrative Hearings (“OAH”) by Respondent Fausto Ordonez on September 16, 2025, makes the following minute entry:

The ALJ is denying the request, at this time, due to being overbroad in its current form.

In addition, this ALJ urges the parties to meet and confer on the requested items included in the subpoena. If items are not agreed upon in the subpoena request and Respondent wants to resubmit the request, a brief statement of the relevance of testimony and/or documents would be required per Ariz. Admin. Code R2-19-113(B).

It is ordered that a joint stipulation of facts is requested and each party must submit and exchange a list of witnesses and copies of their proposed exhibits, not less than five business days before the commencement of the due process hearing. The disclosure date is October 13, 2025.
