Respondent’s motion is granted. Respondent Exhibit 5 is hereby designated as non-public and confidential under the authority of Ariz. Rev. Stat. §§ 16-168(F), 28-455, 41-319(A)(5-6), and U.S.C. § 2721.

Based on the foregoing,

IT IS ORDERED designating as non-public Respondent Exhibit 5.

IT IS FURTHER ORDERED that the Administrative Law Judge may designate portions of the audio record and/or court reporter’s transcript as non-public on the express condition that counsel for Respondent alert the undersigned in advance when non-public testimony is going to be offered.
