ORDER FOR VIRTUAL APPEARANCE

On June 3, 2024, the Arizona Board of Technical Registration (the Complainant) filed a Motion for Electronic or Telephonic Testimony for the hearing in this matter set for June 7, 2024. The Complainant refers to the Ariz. Admin. Code, R2-19-114, which allows this Tribunal to permit telephonic testimony.

Ariz. Admin. Code R2-19-106 allows Parties to request rulings from this Tribunal on issues including the allowance of telephonic testimony under Ariz. Admin. Code R2-19-114. That Rule also sets procedure for the Form, Time Limits, Response to Motion, Oral Argument, and Rulings. It sets, in part, that “[a]bsent good cause, or unless otherwise provided by law or these rules, written motions shall be filed with the Office at least 15 days before the hearing.” Ariz. Admin. Code R2-19-106(C) (emphasis added).

The Motion for Electronic or Telephonic Testimony does not satisfy the timing requirements, and the Complainant does not attempt to demonstrate good cause “by showing that the grounds for the motion could not have been known in time, using reasonable diligence...” Id.

However, this Tribunal is permitted to waive the application of the rules “to further administrative convenience, expedition, and economy if: 1. The waiver does not conflict with law, and 2. The waiver does not cause undue prejudice to any party.” Ariz. Admin. Code R2-19-102(B).

This Tribunal has determined that waiving the 15 days does not conflict with law or cause undue prejudice to any party. Accordingly, the Motion for Electronic or Telephonic Testimony is GRANTED and this hearing will be conducted both in person and by video conferencing or telephone participation through Google Meet as follows:
