ORDER DENYING MOTION

On July 7, 2024, Petitioner filed a Motion for Contempt Proceedings or Alternative Sanctions (Motion) with the Tribunal. Petitioner requested the Tribunal to begin contempt proceedings in Superior Court based on Respondent’s failure to respond to a subpoena.

IT IS ORDERED denying the Motion. Petitioner may proceed to enforce the subpoena in Superior Court and, if he determines necessary, to request a continuance in the above entitled matter to proceed with the Superior Court proceedings.

IT IS FURTHER ORDERED the administrative hearing remains scheduled for September 18, 2024 at 9:00 a.m. In the event the parties resolve the matter informally, the parties shall file a motion to vacate the hearing.
