Minute Entry Rejecting Documents

On September 11, 2024, the Tribunal received from Petitioner multiple filings, among them a filing designated to be “Proposed ALJ Decision” and “Proposed Findings, Conclusions and Orders,” and a subsequent filing purporting to make typographical corrections to the document(s). On September 13, 2024, Respondent filed an Objection to the named filings.

The Administrative Law Judge, having reviewed only the descriptions of the above noted filings and not the content, makes the following minute entry:

The Administrative Law Judge is required to conduct an administrative hearing, and then make independent recommendations with Findings of Fact and Conclusions of Law based on relevant evidence admitted and considered by the Administrative Law Judge. While in some cases, the parties might both be requested to provide proposed findings of fact, the Administrative Law Judge would typically not make such a request prior to the conduct of a hearing and would restrict such to be dependent solely on the relevant evidence that was admitted to a hearing record.

The Petitioner’s documents referenced herein will not be considered by the Administrative Law Judge. Although those documents will be retained in the case file, they are not admitted to the hearing record and need not be responded to by any party.
