ORDER DENYING PETITIONER JOHN KRAHN’S PROCEDURAL MOTION

Pending before the Office of Administrative Hearings is John Krahn’s Motion to present argumentative testimony or argument contemporaneous with testimony during the hearing. Respondent has filed a response opposing the Motion. Having reviewed the Motion and the response,

IT IS ORDERED that both parties may present argument during the hearing pursuant to Arizona Administrative Code R2-19-115(A).

IT IS FURTHER ORDERED denying John Krahn’s Motion to present argumentative testimony, or argument contemporaneous with testimony, pursuant to Arizona Revised Statutes section 41-1092.07(D) and Arizona Administrative Code R2-19-116.

IT IS FURTHER ORDERED, to ensure an efficient and fair hearing, that the procedure of the hearing shall be as follows:

Opening statements will be limited to a brief outline of the anticipated

evidence;

The presentation of evidence will be factual, limited to testimony and

exhibits (with only necessary foundational explanations); and

Legal argument and application of law to facts will be reserved for closing

argument.
