As discussed at the hearing on March 6, 2024, the record in this matter is held open until March 27, 2024 for the submission of written closing arguments. Petitioner is required to submit a written closing argument by March 13, 2024. StarPass Master Homeowner Association, INC. is required to submit is written closing argument by March 20, 2024. Petitioner may submit a reply, if any, by March 27, 2024.

The issues in dispute are whether Star Pass violated Arizona Revised Statues (A.R.S.) §§ 33-1804, 33-1810, 33-1817, Bylaw Article Section 1, CC&Rs Article 3 Section 2(b), Section 5, and Article 11, Section 8, by allowing the Declarant to be the sole person to appoint the Board of Directors, without notice, a meeting of the members, and/or a vote of the members, and failing to hold annual meetings of the Association’s members.
