The undersigned Administrative Law Judge, pursuant to a prehearing conference held this date in the above-captioned matter to address Petitioners’ Motion to Order Limited Discovery and Respondent’s objection thereto, makes the following minute entry:

Petitioners’ request to depose eight (8) potential witnesses is denied. Petitioners’ request to depose HOA attorney Curtis Ekmark, Esq. is also denied.

The issue of questioning one or more witnesses regarding alleged privileged communications is tabled. At the Tribunal’s discretion, or by request of a party, a potential witness may be subject to voir dire on a confidential hearing record to determine the nature and admissibility of their testimony.

The parties are hereby reminded that disclosure is due today – Tuesday, February 20, 2024. A list of potential witnesses and their anticipated testimonies, as well as all proposed marked hearing exhibits, must be received by or before 5:00 p.m. Parties must ensure their witness(es) receive all proposed hearing exhibits in this matter.

The following deadlines are in effect for these proceedings:

Subpoena deadline – Tuesday, March 05, 2024.

Prehearing memoranda – Monday, March 18, 2024.

Closing briefs – TBD.
