ADMINISTRATIVE LAW JUDGE DECISION

HEARING: March 21, 2024 with the record held open until April 22, 2024, for the sole purpose of allowing the court reporter’s transcript to be admitted into the record.

APPEARANCES: Khursheed Haider M.D. did not appear. Assistant Attorney General Elizabeth Campbell represented the Arizona State Board of Nursing (Board).

FINDINGS OF FACT

1. The Board is the duly constituted authority for licensing and regulating the practice of allopathic medicine in the State of Arizona.

2. On February 13, 2024, the Arizona Board issued a Complaint and Notice of Hearing setting this matter for hearing at 9:00 a.m. on March 21, 2024.

3. No representative appeared for Dr. Haider at the scheduled hearing-time and the matter was convened in his absence at about 9:15 a.m.

4. The Board presented the testimony of Board Investigator, Daniela Schulten, and submitted exhibits 1 through 9.

5. On November 21, 2023, Dr. Haider was indicted on a charge of 18 U.S.C. § 2252(A)(4) (Possession of Child Pornography) in the U.S. District Court, Eastern District of California case 2:23-mj-00152-AC-1.

6. Dr. Haider did not report the charge to the Board within 10 days.

7. On December 20, 2023, the Texas Medical Board (Texas Board) issued an Order of Temporary Suspension of Respondent’s Texas medical license. The Texas Order was based on the California indictment and included a determination that Respondent’s continuation in the practice of medicine would constitute a continuing threat to the public welfare.

8. During the Board’s consideration of the above-captioned matter on January 31, 2024, Board staff presented the foregoing, including Board’s staff’s attempts to contact Dr. Haider.

9. Based on the evidence presented, the Board unanimously voted to summarily spend Dr. Haider’s license.

10. On February 1, 2024, the Board issued an Order Summarily Suspending Dr. Haider’s license to practice medicine.

CONCLUSIONS OF LAW

1. The Arizona Board has jurisdiction over Dr. Haider and the subject matter in this case under Arizona Revised Statutes § 32-3202.

2. Pursuant to A.R.S. § 41-1092.07(G)(2) and A.A.C. R2-19-119(B), the Board has the burden of proof in this matter. The standard of proof is by clear and convincing evidence. A.R.S. § 32-1451.04.

3. The Arizona Board established by clear and convincing evidence that

Dr. Haider engaged in unprofessional conduct, based on the conduct described in Findings of Facts 1-9, which is a violation of A.R.S. § 32-1401(27)(a) and (p).

5. Because Dr. Haider has committed acts of unprofessional conduct, the Arizona Board has authority to discipline his license. A.R.S. § 32-1451(M).

6. Given Dr. Haider’s egregious behavior and his failure to appear at the

duly noticed hearing, Dr. Haider has demonstrated that he is not amenable to regulation by the Board. Consequently, Dr. Haider’s license should be revoked.

RECOMMENDED ORDER

IT IS ORDERED that the Board’s Order of Summary Suspension of Khursheed Haider, M.D.’s License No. 54596 is affirmed.

IT IS FURTHER ORDERED that Khursheed Haider, M.D.’s License No. 54596 is revoked.

Pursuant to A.R.S. § 41-1092.08(I), the licensee may accept the Administrative Law Judge Decision by advising the Office of Administrative Hearings in writing not more than ten (10) days after receiving the decision. If the licensee accepts the Administrative Law Judge Decision, the decision shall be certified as the final decision by the Office of Administrative Hearings.

In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
