ORDER AMENDING RECOMMENDED ORDER

On October 25, 2024, the Arizona State Board of Nursing (Board) submitted a Motion for Reconsideration as to the Recommended Order in the Administrative Law Judge Decision, issued September 16, 2024. On November 8, 2024, Respondent filed a Response, requesting that the Tribunal deny the Motion.

In its Motion, the Board notified the Tribunal that “Stayed Revocation Probation” is distinct from the “probation” allowable under A.R.S. § 32-1601(12). It requested that the Tribunal impose detailed terms and conditions of probation, going beyond the Tribunal’s recommendation. It also requested that the recommended continuing education be completed during a suspension period, prior to starting probation, and that the Tribunal uphold the summary suspension.

Pursuant to A.R.S. § 41-1092.08(D), the Board may accept, reject, or modify the decision. The Recommended Order, as originally written, recommended parameters for a probation program; it necessarily required expert finessing by the Board. The Tribunal declines to impose the requested probation terms or extend the recommended suspension. If the Tribunal proposed terms, they would differ from the Board’s standard language to reflect the issues in this matter and the nature of Respondent’s practice.

IT IS ORDERED that, within the Recommended Order, the term “Stayed Revocation Probation” be replaced with “probation.”

IT IS ORDERED the remaining modifications are denied.
