The Arizona Department of Agriculture, Central Licensing Division (the “Division”) is denying your application for Certified Applicator. The Division may suspend or deny a license for a misdemeanor conviction involving moral turpitude or a felony. Arizona Revised Statutes (“A.R.S.”) §§ 3-3621(G) and 3-3624(B)(8); and Arizona Administrative Code (“A.A.C.”) R3-8- 203(B).

The results of your background check indicate that you have been convicted of a misdemeanor involving moral turpitude and/or a felony.

The decision to deny your application should be considered a final Division action. Pursuant to Title 41, Chapter 6, Article 10, A.R.S. § 41-1092, et seq., you have the right to request a hearing to appeal this decision. Your hearing request must be filed within 30 days of receipt of this Notice. The request for hearing (appeal) must include your name; your address and other contact information; and the specific action being contested. The request must also contain: (1) a concise statement of the reasons for the appeal; (2) detailed and complete information regarding all questions of law, if applicable, that are the basis for the appeal; (3) all relevant supporting documentation; and (4) how you are an adversely affected party, if applicable.

If you request a hearing, you also have the right to request an informal settlement conference pursuant to A.R.S. § 41-1092.06, by filing a written request with the Division no later than twenty (20) days before a scheduled hearing. A request for an informal settlement conference does not suffice as a request for a hearing, and does not extend the deadlines for requesting or holding a hearing. I am writing this appeal for the reconsideration of my eligibility for the state license necessary for my employment with Hickman Farms. While I understand that my past conviction may raise concerns, I wish to present my case for redemption and demonstrate my commitment to contributing positively to society through continued employment.

I am James Dennis and I take full responsibility for my past actions, which led to my conviction. Since that time, I have embarked on a journey of personal growth. I have actively accepted opportunities to better myself.

I have become an asset to my community and my employment with Hickman Farms.

I am excited about the opportunity to continue to use my skills and experience in a meaningful way with Hickman Farms. Despite my past, I am determined to prove my worth through dedication, hard work, and commitment.
