PREHEARING ORDER

A telephonic prehearing conference was held on November 8, 2023, at 11:00 a.m. Assistant Attorney General Linda Bergevin represented the Arizona Department of Liquor Licenses and Control (“Department”). Kimberly Eckert, Esq. represented Kandies Cabaret Private Gentlemen’s Club (“Appellant”).

Deadlines for the exchange of exhibit and witness lists, and exhibits were discussed and agreed upon. Pursuant to the agreement of the parties,

IT IS ORDERED that on or before November 15, 2023, at 5:00 p.m., the parties shall file with the Office of Administrative Hearings and provide a copy to their opponent the exhibits that they plan to submit, along with a List of Exhibits that provides a designation and brief description of each exhibit. The Department shall use numbers to designate its exhibits; Appellant shall use letters to designate its exhibits. The parties may file documents electronically with the Office of Administrative Hearings at www.azoah.com.

IT IS FURTHER ORDERED that on or before November 15, 2023, at 5:00 p.m., the parties shall file with the Office of Administrative Hearings and provide a copy to their opponent a List of Witnesses whose testimony they plan to present, along with a brief description of the witnesses’ anticipated testimony.

IT IS FURTHER ORDERED as agreed upon by the parties, that any prehearing memoranda shall be filed on or before November 29, 2023, at 5:00 p.m.

IT IS FURTHER ORDERED that the parties shall file any stipulations to the admission of exhibits and any stipulations of fact with the Tribunal prior to the hearing date.
