AND PREHEARING ORDER

A Prehearing Conference in this matter was held on September 13, 2024, at 9:00 a.m. Assistant Attorney General Casey Hutchison represented the Arizona Naturopathic Physicians Medical Board. Steve Mahaffy, Esq. represented Respondent Jose Ortiz, N.M.D.

To summarize what was discussed at the pre-hearing conference:

The parties requested that the hearing be set for two full consecutive days. The parties were instructed to provide their dates of availability in the months of December 2024 and January 2025, and to advise the Tribunal if they preferred the matter be set in-person or via Google Meet. The parties provided dates of availability, however, did not provide a preference as to the manner in which the hearing will be held, and did not respond to further inquiry from the Office of Administrative Hearings.

Therefore,

IT IS ORDERED that the hearing will commence on January 13, 2025, at 9:00 a.m. with further hearing on January 14, 2025, at 9:00 a.m.

IT IS FURTHER ORDERED that on or before January 3, 2025, at 5:00 p.m., the parties shall file with the Office of Administrative Hearings the exhibits that they plan to submit, along with a List of Exhibits that provides a designation and brief description of each exhibit, as well as a List of Witnesses whose testimony they plan to present, along with a brief description of the witnesses’ anticipated testimony.

IT IS FURTHER ORDERED that no later than December 30, 2024, either party may submit a prehearing brief not to exceed twenty (20) pages in length. In the event a party chooses to submit a prehearing brief, the opposing party may submit a responsive brief within five (5) days thereafter.
