The undersigned Administrative Law Judge, having reviewed the document Motion Requesting Order Permitting Deposition Testimony of Petitioner’s Witness and Authorizing Use of that Video Testimony at Hearing as filed by Petitioner May 13, 2025, as well as Respondent’s reply in opposition received May 19, 2025, and Petitioner’s May 20 2025, response in support of its motion makes the following minute entry:
Petitioner’s motion for deposition is denied. Petitioner may, subject to further objection by Respondent, request that an additional further hearing date be scheduled so that Jeremy Calles can testify on its behalf, or alternatively, offer a sworn and notarized declaration, attestation, or affidavit from Mr. Calles for consideration as evidence in the above-captioned matter.
