DENIAL ORDER

On May 17, 2024, the Arizona School Facilities Oversight Board (“Board”) issued a Notice of Hearing setting an administrative hearing in the above-captioned matter before the Office of Administrative Hearings (“OAH”), an independent state agency, to determine whether the Board properly or otherwise lawfully denied Appellant’s request for monies from the Fund additional square footage.

From May 29-30, 2025, the matter was heard, holding the record open until June 11, 2025, for receipt of Closing Arguments from the parties, and Rebuttal Arguments on July 02, 2025, and July 17, 2025.

On July 31, 2025, the undersigned issued a Recommended Order to the Director of the Arizona Department of Administration (“Department”) that held the January 22, 2024, Notice of Denial for Monies from the Fund be overturned by the referring agency, and further held that Respondent award grade 9-12 space to Appellant for no less than an additional 1,013 students. Notice was specifically provided to the parties that, “In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Final Order will be forty (40) days from the date of that certification.”

On September 03, 2025, the parties submitted a Notice of Settlement and Stipulation to Dismiss Appeal.

In light of the foregoing,

IT IS ORDERED that the parties request is denied as moot, absent lawful authority. OAH ceased jurisdiction over this matter July 31, 2025.
