HEARING

On February 1, 2023, Petitioner filed a Motion to Vacate/Withdraw Hearing with the Office of Administrative Hearings in which Petitioner advised of the following:

On January 31st, 2023 an entirely new board was elected by the homeowners for the Eagle Crest Ranch Homeowners Association (ECR HOA). I feel it isn't fair to penalize a new board for the misdeeds of the previous board. I believe the new board will be a lot more compliant with ARS, CC&R's, our bylaws, design guidelines and violation enforcement policy. I'm looking forward to a law abiding and ethical board in 2023.

Based on the above,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Department of Real Estate for any further action.
