MINUTE ENTRY - GRANTING CONTINUANCE
AND SETTING STATUS DATE
The hearing in the above-captioned matter was scheduled to convene on December 13, 2023, at 9:00 a.m. On the date and time set for hearing, Assistant Attorney General Elizabeth Campbell represented the Arizona Regulatory Board of Physician Assistants (“Board”). Kerry Malin, P.A. appeared on his own behalf. The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. As a result of that discussion, the parties resolved the matter to be determined at hearing by executing a Consent Agreement. However, the Consent Agreement must be approved by the Board at its next regularly scheduled meeting, set to take place on February 28, 2024. The parties requested that this matter be set for a written Status Update after the Board’s meeting.
Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a Status Update on March 4, 2024. On or before this date, the parties are advised to do one of the following:
Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;
Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or
Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
