ORDER REQUESTING STIPULATION FROM PARTIES SETTING OUT MATERIAL FACTS FOR AGREED UPON CERTIFICATION ELECTION

At the time of hearing in this matter, the parties presented this tribunal with a written set of stipulated facts regarding all issues relating to this matter and further apprised this tribunal that they had reached agreement so that a consent election could go forward on January 12, 2024 form 7 to 11 am at the Green Sky patient care Center in Scottsdale, Arizona. Thus, there are no material disputes of either fact or law to be resolved and the parties have resolved their dispute without the need for hearing by agreeing to a consent election agreement. In light of the parties’ agreement for a consent election, this matter is returned to the AERB for all further proceedings.
